Terms of Service

These Terms of Service ("Terms") govern the contract between Shazark S.r.l. ("tapphost", "we", "us") — VAT/P.IVA IT12620720966, REA 2673165, registered office Corso Buenos Aires 77, 20124 Milano (MI), Italy — and you ("Customer") for the services offered at tapphost.com. By placing an order you accept these Terms.
1. Services
tapphost provides web hosting, domain registration, AI agents and automations, and related marketing services ("Services"), as described on the website and in the order you place. Technical specifications, resources and features are those indicated for the plan you select at the time of purchase.
2. Account & eligibility
You must provide accurate, complete and current registration and billing information, including a valid VAT number or Codice Fiscale where legally required for invoicing. You are responsible for keeping your login credentials confidential and for all activity under your account.
3. Orders, prices and taxes
Prices are shown on the website and in your cart at the time of order, in Euro, and — unless otherwise stated — exclusive of VAT, which is added where applicable. For Italian VAT-registered customers, invoices are issued electronically through the Italian Exchange System (SDI) using the SDI recipient code or PEC you provide. A binding contract is formed when we confirm your order and/or issue the corresponding invoice.
4. Payment, billing cycle and renewals
Services are billed in advance for the billing cycle you choose (e.g. annually). Payment is processed by our payment providers (Stripe, Stripe SEPA, PayPal). Unless you cancel before the renewal date, subscriptions and domains renew automatically for the same period at the then-current price; we send a renewal invoice in advance. You can disable auto-renewal or cancel from your client area or by contacting us.
5. Domain names
Domain registrations are subject to the rules of the competent Registry and Registrar and to ICANN policies (and, for .it, the Registro .it rules). You are responsible for providing accurate registrant data. Once a domain is registered, the registration fee is non-refundable, as the service has been fully performed.
6. Free migration & setup
Where offered, we migrate your existing site to tapphost at no additional charge, on a best-effort basis. You are responsible for holding a backup of your data before any migration.
7. 30-day money-back guarantee
New hosting plans include a 30-day money-back guarantee: if you are not satisfied, contact us within 30 days of activation for a refund of the hosting fee. The guarantee does not cover domain registrations/renewals, setup fees, add-ons already provided, or third-party costs.
8. Right of withdrawal (consumers)
If you are a consumer, you generally have 14 days to withdraw from a distance contract under the Italian Consumer Code (D.Lgs. 206/2005). However, by requesting immediate activation of the Services and expressly consenting at checkout, you acknowledge that: (a) for digital services fully performed, the right of withdrawal is lost once performance has begun with your consent; and (b) domain registrations are excluded from withdrawal. 9. Acceptable use
You must not use the Services to store or transmit unlawful, infringing, malicious or abusive content, to send spam, to compromise security, or in any way that harms tapphost, its infrastructure or third parties. We may suspend Services in case of serious or repeated violations, or where required to protect the platform.
10. AI features — disclaimer
AI agents and automations generate outputs automatically and may occasionally be inaccurate or incomplete. They are provided "as is"; you are responsible for reviewing and for how you use their output. AI features are not a substitute for professional (legal, medical, financial) advice.
11. Service levels, maintenance & backups
We target 99.9% monthly uptime but do not guarantee uninterrupted or error-free service. Scheduled maintenance may cause brief interruptions. While we perform backups for continuity, you remain responsible for keeping your own backups.
12. Suspension & termination
Either party may terminate for the future by disabling renewal. We may suspend or terminate Services for non-payment, breach of these Terms, or legal reasons. On termination, your data may be deleted after a reasonable period; export it beforehand.
13. Intellectual property
The tapphost platform, brand and content are owned by Shazark S.r.l. Your content remains yours; you grant us the limited rights necessary to operate the Services on your behalf.
14. Limitation of liability
To the maximum extent permitted by law, our liability for any claim relating to the Services is limited to the amount you paid for the affected Service in the 12 months preceding the event. We are not liable for indirect or consequential damages, loss of profits or loss of data beyond what the law mandates. Nothing limits liability that cannot be limited by law, including consumers' mandatory rights.
15. Data protection
We process personal data as described in our Privacy Policy. Where we act as your data processor for content you host, a Data Processing Agreement is available on request.
16. Changes to the Terms
We may update these Terms; the "Last updated" date reflects the current version. Material changes affecting active services will be communicated in advance, and continued use after they take effect constitutes acceptance.
17. Governing law & disputes
These Terms are governed by Italian law. For consumers, the mandatory jurisdiction is the court of the consumer's place of residence or domicile; for businesses, the exclusive jurisdiction is the court of Santa Maria Capua Vetere. Consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
